General Terms & Conditions

Please take time to read our terms and conditions carefully as they are designed to protect and clarify your legal rights as well as our own. Please also read our privacy statement regarding any personal information you may provide. The terms and conditions outlined here apply to all Cloth & Clover products that may be included as part of the Cloth & Clover collection. Products

We reserve the right to modify or withdraw items from our range at any time and without prior notification. There is a 2 metre minimum order length for fabric. Our wallpaper is printed to order on to a wide width paper, the minimum order quantity is 10 metres. Cloth & Clover does not give or imply any warranty as to the quality or suitability of its goods; you must ensure that any product supplied by us is fit for the purpose for which you intend to use it, prior to ordering.

Pricing

Prices are quoted in UK Sterling and inclusive of VAT at the prevailing rate. Prices may be subject to change at any time – the current price will be quoted at time of order. Prices are exclusive of duty for international orders. The prices shown for products on the website are exclusive of delivery. The cost of delivery will be added to the total price at check out. More detailed information can be found in the delivery section on the website. Overseas delivery charges will be calculated individually and we will advise directly by email or phone.

Payment

All orders via the Cloth & Clover website are payable in full at time of order. Online payment is processed by Stripe Payments Europe Limited – which accepts payment by credit card and debit card. Stripe Payments Europe, Ltd is PCI compliant. PCI-DSS (Payment Card Industry Data Security Standard) This is the most stringent level of certification available in the payments industry. Your transaction is handled directly by Stripe which means your personal financial details are securely encrypted on their servers, not ours. For further details please visit stripe.com

Ordering Process

Please email us at enquiries@clothandclover.com to place your order. We will contact you directly if we have any queries or if we are unable to fulfil the order. No contract will exist until we have accepted and confirmed your order in writing and the goods have been dispatched and delivered – this represents the time at which a Contract of Sale is made between Cloth & Clover and you.

Lead Times

Our fabrics are printed in short runs and often printed to order, so lead times may vary depending on stock. We aim to process and dispatch orders within 5 working days, upon receipt of payment and if the fabric is in stock. We will advise lead time at the time of order if fabric is out of stock  – this is usually around 4 weeks from receipt of order. All delivery dates are estimates. We will make every effort to keep you informed of any delays should they arise; however we are not liable for the consequence of any delay. Any delay of part of an order against an estimated delivery date does not entitle you to cancel the order.

Amendments or Cancellation of Orders

You have the right to cancel your order within 7 working days from the day after receipt of goods as per The Consumer Protection (Distance Selling) Regulations 2000. Notification of cancellation or amendment of your order, once placed, should be made to Cloth & Clover in writing – we will endeavour to amend orders already in the system, however we cannot amend or cancel a fabric order once the fabric has been cut or dispatched. We are unable to cancel bespoke orders if the product has already gone into production.

Returns Policy

We accept returns on products that are damaged, faulty or incorrect, however we are unable to accept returns of partial or cut lengths from your original order. Returns of bespoke products will only be accepted where products are found to be faulty or damaged upon receipt. You are responsible checking all goods upon receipt of delivery and should notify Cloth & Clover in writing of any faults or defects within 5 working days of delivery, whereupon we will offer a replacement or refund. We cannot accept responsibility for any discrepancies or faults after this time. Cloth & Clover are not responsible for return postage other than for incorrect or faulty items – please therefore ensure that you attach the correct postage. We strongly advise that you use recorded or special delivery and retain proof of postage for returns, as we are unable to accept responsibility for parcels that fail to reach us.

Refunds

Returned goods that Cloth & Clover have acknowledged as faulty or incorrect will be refunded to you in full, we will also refund the cost of returning the goods to us. Refunds will be made as quickly as possible – we aim for within 5 working days from receipt of returned goods.

Liability

All goods are supplied by Cloth & Clover on the strict condition that our liability for any fault or defect in the quality, condition, description or fitness for any purpose is limited in amount to a sum not exceeding the purchase price of the particular goods. It is your responsibility to check that you have received the correct order before further processing or passing on to a third party.

End Use of Fabric

Our fabrics are intended for interior decoration for curtains, blinds, light upholstery etc. We use our fabrics to make our own range of handmade and bespoke accessories – we therefore reserve the right to refuse the sale of our fabric to those who intend making products for resale. We also reserve the right to refuse the sale of our fabric for resale by the metre without our prior permission.

 Colour Matching

Every care is taken by us to ensure the consistency of colour across our collection, however because we use natural fabrics and fibres, there will be slight variations in the weave and colour from batch to batch. Please ask for stock cuttings before ordering if exact colour matching is required.

Website Content

Every care has been taken to ensure that the information we have posted on the website is accurate and that all products are accurately and fairly described. All quoted prices for goods and delivery costs are correct at the time of posting, however please note that products and prices are subject to change. We have made every effort to ensure that the colours in the photographs of the product appearing on our website are as near as possible to the colour of the original items. However individual computer screens will display the content differently, accordingly, we are unable to guarantee precise colour matches to the original product shown on the website. Please note that some photographs and images on the site may not be shown to scale – please refer to the measurements provided.

We respect the copyright, trademark and intellectual property rights of others and we ask that you do the same. We welcome you sharing our photos in the appropriate manner, but please ensure that you credit Cloth & Clover and include a link to our website when you use Pinterest, Instagram, Flickr or other photo sharing sites.

Privacy Policy & Data Protection

Cloth & Clover are committed to protecting your privacy, and will only use the information that we collect about you lawfully and in accordance with the General Data Protection Regulation (GDPR) (EU) 2016/679 and associated legislation. We request personal information from you in order to process your order and also to enable us to contact you should any queries regarding you order arise. We will not send you any marketing or promotional emails unless you agree to it. We will not pass your personal details to any other third party for marketing purposes. We do not have access to your credit card or bank details as this is handled directly by Stripe Payments Europe Limited.

These terms and conditions and each contract of sale are governed by English Law.
